Rights and obligations between husband and wife

Under Art. 68 of the family code. It provides the rights and obligation of husband and wife that must prosper.

The husband and wife are oblige to live together, observe mutual love, respect and fidelity, and render mutual help and support.

Duty to live together

The duty to live together includes cohabitation or consurtium and sexual intercourse. The wife may refuse to have sexual intercourse with the husband if he resort to abnormal or perverse practices.

If the husband forces the wife to have sexual intercourse with him against her will, he maybe charged with coercion.

Duty to observe mutual love, respect and fidelity

These duties are personal to the spouses and go into their intimate relations, so that they must be performed voluntarily by them. However, some consequences of such duties are the following:

The unfaithful spouse may be charged criminally with adultery in the case of the wife or of concubinage in the case of the husband.

If one of the spouse commits acts which tend to bring the danger, dishonor, or injury to the other, the aggrieved spouse may apply to the court for relief...

Kinds of Bigamous Marriages

There are two kinds of bigamous marriages namely:

1. The void bigamous marriage, which is contracted by a person during the subsitence of his or her previous marriage. Here, the good faith of the party who marries again is immaterial; the second marriage would still be void.

On the other hand, the person who marries again in bad faith is even criminally liable for bigamy; and

2. The voidable bigamous marriage, which is contracted by a person whose spouse has been absent for four consecutive years or two years, said person having well-founded belief that his or her spouse was already dead, and after having the latter judicially declared presumptively dead in a summary proceeding as provided by law

For not criminally liable at the second paragraph. The present spouse must first ask for a declaration of presumptive of death of the absent spouse in order not to be guilty of bigammy in case he or she marries again.

Under art. 37 of the Family code, set the rules: The action or defense for the declaration of absolute nullity of a marriage shall not prescribe. However, in the case of marriage celebration before the effectivity of this code and falling under Art. 36, such actions or defense prescribe in ten years after this code shall have taken effect.

Matrimonial Consent

Under Art. 36 Of the Family Code; A marriage by any party who, at the time of the celebration, was psychologically incapacitated to comply with the essential marital obligations of marriage, shall likewise be void even if such incapacity becomes manifest only after its solemnization.

Exceptional Marriage

This refers to "marriages exempt from the license requirement" which provide under Art. 27 of the Family Code...says: In case either or both of the contracting parties are at the point of death, the marriage maybe solemnized without the necessity of marriage license and shall remain valid even if the ailing party subsequently survives.

Articulo Mortis

The marriage referred to in this Article is the marriage in articulo mortis; i.e., or both of the contracting parties are dying or at the point of death. In such case, there is no need for marriage license because obviously, the dying party would already be dead by the time the license is issued.

What happens if the parties are survives from the point of death?

Under Art. 72 of the civil code, which is the source of the article. Provides that the marriage remains valid even if the ailing or dying party survives or does not dies.
