Under Art. 68 of the family code. It provides the rights and obligation of husband and wife that must prosper.
The husband and wife are oblige to live together, observe mutual love, respect and fidelity, and render mutual help and support.
Duty to live together
The duty to live together includes cohabitation or consurtium and sexual intercourse. The wife may refuse to have sexual intercourse with the husband if he resort to abnormal or perverse practices.
If the husband forces the wife to have sexual intercourse with him against her will, he maybe charged with coercion.
Duty to observe mutual love, respect and fidelity
These duties are personal to the spouses and go into their intimate relations, so that they must be performed voluntarily by them. However, some consequences of such duties are the following:
The unfaithful spouse may be charged criminally with adultery in the case of the wife or of concubinage in the case of the husband.
If one of the spouse commits acts which tend to bring the danger, dishonor, or injury to the other, the aggrieved spouse may apply to the court for relief...
