In the Philippines, divorce is a heated arguments in congress. But many are opposed about the passage of the bills, due to public policy concern and morality. Even do divorce is not allow in the Philippines, there's a law concerning marriage settlement. This law is under the family which the purpose is to strengthen family relation and protect the family and it's concern.
But couples want to distract the sanctity of marriage and still want to get involve into an illicit relationship to others not their wife or their husband and when they caught doing such adulterous and concubine acts. To justify their wrong doing, they strongly denies such allegation.
Many couples are suffered physically and mentally abuse from their husband or wives who corrupt their innocent minds.
Due to those events. law makers set a remedy to counter divorce. The remedy for those irreconcilable quarrels, abuse, or in effect of psychological incapacity. Husband any wife may file a legal separation if they want to cool off or file a declaration of absolute nullity.
Under art. 37 of the Family code, set the rules: The action or defense for the declaration of absolute nullity of a marriage shall not prescribe. However, in the case of marriage celebration before the effectivity of this code and falling under Art. 36, such actions or defense prescribe in ten years after this code shall have taken effect.
